Application to use images of the Museum of Menorca's pieces
The Museum of Menorca makes available the archive of images of works and artefacts for those who apply for them, as long as the following terms and conditions are met:
Application process timeframes
The Museum of Menorca will respond to any requests and will send the images within a minimum period of 15 days and a maximum of 2 months.
Publications
In the event that the images are intended to be used for publishing purposes, it is understood that the awarded authorisation will only apply to the first edition of said publication. If the image was to be used in an advertising campaign, you must specifically state in the description the kind of advertisement, format/s and means of communication.
In the event that the images are to be used for a study or research that will be subsequently published, the applicant shall be the responsible for communicating these publishing terms and conditions to the publishing house and must supply the Museum of Menorca with the relevant information in order to start the reproduction rights procedure.
Integrity of the artefacts
Any reproduction of pictures of the Museum of Menorca must respect its integrity (the size or colour may be modified for publishing purposes). The reproduction of a detail or a part of the image shall require previous authorisation. In this event, the credits must include the word "detail". Those pictures handed over by the Museum of Menorca cannot be altered in any way. The overlapping of the image with other images or texts shall not be permitted without previous authorisation.
Copies
The undersigning person commits him or herself to send the Museum of Menorca two copies of the product on which the pictures provided by the Museum are to be published. This condition applies both for the publishing of books as well as for video production, audio-visuals or other products suitable for the reproduction of images.
Prohibition to make duplicates and handing over to third parties
It is strictly forbidden to make any duplicates and to hand the images over to third parties.
Credits
The publication where the pictures are to be used must include the relevant caption and the following credit:
- Museum of Menorca, Maó (year)
- Photograph: (©/ author's name, when necessary)
Third party rights
Any royalties still in force referred to original works of art shall be settled by the applicant who should therefore previously contact either the relevant artist, VEGAP (Visual Body about Plastic Artists Management) or the relevant royalty management body, that shall duly provide information about such rights costs. In the event of works governed under a commodatum regime, the Museum of Menorca shall contact the relevant author/holder of the work. The receipt of having followed this procedure must be produced to the Museum of Menorca as an essential requirement in order to be granted the authorisation. The Museum of Menorca refuses any liability related to the breach of this requirement.
Breach of terms and conditions
The Museum of Menorca reserves the right to take any relevant legal action against those breaching these terms and conditions. In this sense the Museum of Menorca and the applicant shall be submitted under the jurisdiction of the courts of Maó, and renouncing to their own legal system when different.
